Can my father claim my mother’s property?

Property in Hand

Q: My mother died last month. My father left me and my mother 35 years back, when I was a year old, in my grandparents’ house. All property is on my mother’s name. Will my father get any right on my mother’s property? They did not get divorced.

A: Yes, your father will have a right in the property if they haven’t divorced. However, if your mother has executed a will in your favour, then your father won’t have any right, title or interest in the property.
