Will my husband divorce me if I say no to intimacy?

Hello Sir,

I am afraid of sexual intercourse and hence always refuse it to my husband. Can he divorce me on these grounds?

Other than that we as a couple have healthy sexual life and engage in other acts which lead to satisfaction. Please let me know if legally my husband can leave me?

Sex is an important part of husband and wife relationship. It may not be everything in matrimony but certainly amounts to one of the most important things.

Therefore, if one spouse is denied marital bliss, it would go deep to the root of matrimony and the other spouse will be aggrieved.

Thus legally speaking, a petition for divorce can be filed by the aggrieved spouse citing aversion to sex amounting cruelty to him/her.

There are a couple of recent pronouncements by the High Court of Delhi that held denial of sex can be a valid ground seeking a divorce.

But if both of you are contented, as you stated, then why will your spouse leave you?
